Ballmer Ordered to Testify in "Vista-Capable" Lawsuit

In the soap opera that is the Vista-Capable lawsuit, the latest installment occurred Friday, when Judge Marsha J. Pechman ordered Microsoft CEO Steve Ballmer to testify in the class-action lawsuit, within the next 30 days.

Her ruling (.PDF), as posted at the SeattlePI.com site, says:
The Court appreciates that there are severe demands on Mr. Ballmer’s time; however, a busy schedule cannot “shield” an executive from discovery.
Microsoft had asked for a protective order excluding Ballmer's testimony. The court, however, ruled that Ballmer may have "relevant, unique personal knowledge of relevant facts."

The deposition will take place at a time and place "convenient" to Ballmer.

On Thursday Microsoft asked that the case be dismissed. The case is scheduled to go to trial next April.

If for nothing else, the case has been "enlightening" with its look at the escapades of those involved via unsealed documents and emails (1, 2).
